Duart's Computer Evidence Preservation

Electronic evidence is fragile by nature and can easily be altered or erased without proper handling. Even the simple step of turning on a computer can alter valuable information. To properly preserve and protect critical computer evidence, Duart will:

1. Assist the client in acquiring and then containing the subject computer - regardless of the computer's state or location. Duart can provide legal assistance in preparing documents requesting preservation of the evidence.

2. Provide the client with a detailed report of its finding with accompanying exhibits suitable for court presentation. Our easily understood exhibits can be effectively presented in examinations for discovery, to the Court at trial, or for use in settlement conferences. Duart examiners are also available to provide expert witness testimony if needed.

3. Travel anywhere in North America to contain and initiate the investigative process.

4. Inform clients on how to obtain electronic evidence including such services as:
  • Standard Definitions
  • Precedent Request for Production of Documents
  • Precedent Request for Physical Examination of Computer
  • Precedent Notice of Attendance of Person Most Knowledgeable of Electronic Data Systems and Storage
  • Precedents for a Court Application to Compel Production
